Chancel Repair Searches

A Chancel repair search determines whether a property has liability to its parish church repairs. This search is conducted in person, by making an appointment to inspect the public records held at the Public Records Office in London.

Chancel Repair Liability- “MISCONCEPTION”

The House of Lords ruling in the case of Wallbank v Parochial Church Council of Aston Cantlow and Wilmcote with Billesley, warwickshire, in June 2003 highlighted the existence of the obligation to pay relevant chancel repair costs even if the property owner is not aware of it.

A property may be at potential risk of chancel repair liability even if it is not located in a rural area or close to a church. The fact that there is no mention of chancel repair liability in the Land Registry does not mean that none exist.  Lender Guidance states that chancel repair liability remains the responsibility of the conveyancer in identifying where there is potential risk in the first instance. Avoid any surprises!
